1. Agreement to Terms

4. Account and Registration

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorised use. You must be at least 18 years old and have the authority to bind any organisation you represent.

5. Acceptable Use

Prices may be updated with reasonable notice; continued use after a price change constitutes acceptance. Failure to pay may result in suspension or termination of your account. Unless otherwise stated, fees are exclusive of applicable taxes, which you are responsible for where required.

7. Intellectual Property

OnSeason and its licensors own all rights, title, and interest in the Services, including the software, design, and branding. We grant you a limited, non-exclusive, non-transferable licence to use the Services in accordance with these Terms. You retain ownership of your Content. You grant us a licence to use, store, and process your Content as necessary to provide and improve the Services. You represent that you have the right to provide such Content and that it does not violate any third-party rights.

8. Disclaimers

The Services are provided "as is" and "as available". We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not responsible for the conduct of users or third parties, or for content hosted or transmitted via the Services by users.

9. Limitation of Liability

To the maximum extent permitted by applicable law, OnSeason and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business opportunity) arising out of or related to the Services or these Terms. Our total liability for any claims arising from or related to the Services or these Terms shall not exceed the fees you paid to us in the twelve (12) months preceding the claim. You agree to indemnify and hold harmless OnSeason and its affiliates, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your Content, or your breach of these Terms.

11. Termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access immediately if you breach these Terms or for any other reason with reasonable notice where required by law. Upon termination, your right to use the Services ceases. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of Bulgaria. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Bulgaria, unless mandatory consumer protection laws in your country give you the right to bring proceedings in your place of residence.

13. Changes

Material changes may be communicated by email or a prominent notice on our website. Continued use of the Services after the effective date of changes constitutes acceptance.
